This Agreement, in addition to the Privacy Policy, constitutes the entire agreement of the parties, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The failure of Pediatrics for Parents to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of these Agreement is found by a court of competent jurisdiction to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severed herefrom and shall not affect the validity and enforceability of any remaining provisions. The section headings used herein are for convenience only and shall not be given any legal import.

12. Notices.

If you have a subpoena or other legal notice to serve, please note that Pediatrics for Parents does not accept service via e-mail or fax and will not respond to the subpoena or legal notice (unless it is a properly formatted DMCA claim). 13. Arbitration.

Any dispute or claim relating in any way to your use of the Pediatrics for Parents will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our offices: Liviant, PO Box 5464, Bradford, MA 01835. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial.
